The trial of the lawsuit brought by property buyers against JB’s Country Garden Danga Bay was adjourned in September

On Thursday, Mr Soh said the unit he had been given the keys to looked “very different” from the model unit when he visited the show development apartment in 2013.

In his witness statement, Mr. Soh submitted photographs he took with a digital camera in the showroom and compared them to his actual unit.

He claimed that the quality of the kitchen cabinet, the material of the drawers, the size of the cabinet, the type of door and the type of cooker were different from those presented in the showroom.

“The showroom said we would have a solid wood door for our main door, but all we got was just a fire door,” Soh said.

“I was promised four induction cookers (for the stove) but instead I got two gas burners,” he added.

During Mr. Soh’s testimony, the lawyer representing Country Garden, Mr. Leonard Yeoh, intervened a few times, saying that Mr. Soh was repeating points he had already raised in his submitted witness statement.

“For clarification, I think all of these things are mentioned in the witness statement and it’s a repetition,” the attorney for Tay and Partners said.

“I don’t know why we’re going through all this again since the witness statement was submitted. We’re wasting everyone’s time…I don’t know if it’s for media purposes,” Mr Yeoh added.

Judge Noor Hisham replied that it was “not fair” for the lawyer to “just disregard” the witness’s testimony.

After Mr. Soh testified, the judge adjourned the proceedings until September 11 and said that the defendant’s lawyer would then have the opportunity to cross-examine.

According to its Facebook page, Country Garden Danga Bay is an exclusive and fully integrated residential, commercial and leisure development overlooking the Strait of Johor.

Located in Iskandar Malaysia, an economic corridor in southern Johor, it is a project by Chinese developer Country Garden.

THE DEVELOPER HAS FILED A CLAIM AGAINST FIVE RESIDENTS

Meanwhile, earlier Thursday morning, a case the developer filed against five members of the condominium management committee was opened at the Strata Management Tribunal in Johor Bahru.

Country Garden Danga Bay alleges that it was not informed by the management committee when the latter voted to change the property manager at a meeting held in June.

However, during the hearing, Strata Management Tribunal chairman Abdul Fareed Abdul Gafoor said he had no jurisdiction to grant the claimant’s demands to reopen the tender for the property manager. and order the five committee members to pay compensation for breach. of contract.

Ms. Nurul Ain Mohd Ali Huzairy, a lawyer who was acting in her personal capacity to represent the five committee members, told CNA that the court gave them two weeks to file their submissions.

The developer will then have two weeks to submit its response, she added.

“The case will probably go to court in six weeks, in October,” Ms Nurul Ain said.
